The Democrats don't have much choice, it's an election year.

The entire House is up for re-election and 1/3 of the Senate. Early polls show the Republicans stand a good chance of taking back control of both Congress and the Senate.

AG Holder has botched the KSM case. He said he would move his case to criminal court and hold a trial in NYC, but that KSM would ultimately be found guilty and executed for masterminding the 9/11 attacks.

That sounds like the old westerns I watch "First, we're going to have a fair trial, then we going to hang the cattle rustlers".

Now there are questions whether KSM can get a fair trial after Holder's public statements.

And AG Holder botched the Christmas bomber case, giving him rights after only 50 minutes of questioning.
